NFT Listing Policy

• "NFT": A Non-Fungible Token representing a unique digital asset, including but not limited to images, videos, music, and other digital works, minted and issued by Retinal Delights, Inc. or its authorized creators.
• "Marketplace": The online platform operated by Retinal Delights, Inc. where NFTs are listed for sale, resale, or auction.
• "Seller": An individual or entity that owns an NFT and lists it for sale or transfer on the Marketplace.
• "Buyer": An individual or entity that purchases or acquires an NFT through the Marketplace.

• Retinal Delights NFTs are intended for individuals who are 18 years or older with the legal capacity to enter into binding agreements. If you do not meet these requirements or if applicable law in your jurisdiction prohibits NFT activity, you are not permitted to purchase or interact with our NFTs.

• Only NFTs minted or issued by Retinal Delights, Inc. or its authorized creators may be listed on the Marketplace.
• Sellers must be the rightful owners of the NFT, with ownership verifiable on the relevant blockchain.
• Sellers must comply with all applicable laws, regulations, and the Terms of Service of the Marketplace.

• Accurate Information: Sellers must provide truthful and complete information regarding the NFT, including but not limited to title, description, edition number, creator attribution, and any relevant metadata.
• Intellectual Property: Sellers must have the legal right to transfer the NFT and any associated intellectual property rights. Listings must not infringe upon third-party intellectual property rights.
• Prohibited Content: Listings must not contain offensive, defamatory, illegal, or harmful content.
• Pricing: Sellers set their own listing prices and reserve the right to adjust or remove listings at any time before sale.

• Listing or selling NFTs on the Marketplace may be subject to fees as outlined in the Marketplace Fee Schedule.
• Sellers are responsible for all transaction fees, including blockchain gas fees, marketplace commissions, and payment processing fees.
• Payments will be disbursed following successful transaction confirmation and according to the payout schedule defined by Retinal Delights, Inc.

• All NFTs are provided “as-is” without warranties of any kind. We do not guarantee future value, functionality, market liquidity, or long-term accessibility. You assume full responsibility for your decision to purchase or transfer an NFT.
• Sellers may specify listing duration or choose to keep listings active indefinitely until sale or removal.
• Retinal Delights, Inc. reserves the right to remove any listing at its sole discretion, including but not limited to violations of this Policy or applicable laws.

• Any disputes arising from NFT listings, ownership, or transactions should be initially addressed between Buyer and Seller.
• Retinal Delights, Inc. may mediate disputes but is not liable for resolution outcomes.
• Legal disputes are subject to the jurisdiction and venue as specified in the Marketplace Terms of Service.

• Retinal Delights, Inc. reserves the right to modify this NFT Listing Policy at any time.
• Users will be notified of significant changes through the Marketplace and by email where applicable.
